Terms of service

This is a convenience translation. For contracts governed by German law, the German version is the legally binding one.

§ 1 Scope

These General Terms and Conditions (“GTC”) apply to all contracts you conclude with us – Ahmet Numan Saglam, trading under the brand “Blosha”, Leunaer Str. 4, 12681 Berlin, Germany – through our online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.

We do not accept differing terms and conditions of the customer unless we have expressly agreed to their validity in writing.

§ 2 Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to you to place an order.

By clicking the order button you submit a binding offer to purchase the goods in your cart. Immediately afterwards you receive an automatic acknowledgement of receipt by email, which documents receipt of your order but does not yet constitute acceptance.

The purchase contract is concluded as soon as we accept your offer through a separate order confirmation or dispatch the goods to you.

We store the contract text and send it to you together with the contractual terms by email. The contract language is German.

§ 3 Prices and shipping costs

All prices are final prices in euros and include statutory VAT. Shipping costs are added; their amount depends on format, quantity and destination country. The specific shipping costs are shown to you in the cart and again before you submit your order.

For deliveries to countries outside the European Union, customs duties, import charges and carrier fees may apply, which you pay directly to the relevant bodies.

§ 4 Promotions and discounts

Promotion terms “4 for 3”: Add four participating phone cases to your cart and pay for only three. The lowest-priced participating item is discounted by 100%.

If a partial return brings the number of items below the quantity required for the promotion, the corresponding promotional discount no longer applies. In that case the refund amount is recalculated on the basis of the regular prices of the items you keep. In the event of a full withdrawal, all items received as part of the promotion must be returned, including the item discounted by 100%.

§ 5 Payment

The payment methods available are shown to you during the ordering process. Unless otherwise agreed, the purchase price is due for payment upon conclusion of the contract.

If you fall into arrears with payment, we are entitled to charge default interest at the statutory rate. We reserve the right to assert further damages caused by default.

§ 6 Delivery

Our products are printed individually for you after receipt of your order. Production usually takes one to two business days, after which the item is dispatched.

Within Germany, delivery usually takes 2–5 business days from conclusion of the contract, and correspondingly longer to other countries. Delivery times are non-binding estimates unless a binding delivery date has been expressly agreed.

Delivery is made to the delivery address you provide. We reserve the right to make partial deliveries where this is reasonable for you; you will not incur additional shipping costs as a result.

If an item is unavailable, we will inform you without delay. In that case we refund any payments already made immediately.

§ 7 Retention of title

The delivered goods remain our property until payment has been made in full.

§ 8 Right of withdrawal

Consumers have a statutory right of withdrawal. The details are set out in our withdrawal policy, which also contains the model withdrawal form.

§ 9 Warranty

Statutory liability for defects applies. The limitation period for claims relating to defects in new goods is two years from receipt of the goods.

Please note: our posters are produced using digital printing. Minor colour deviations compared with the on-screen display are possible for production and display reasons and do not constitute a defect.

Please report transport damage to us as promptly as possible – this makes it easier for us to file a claim with the shipping service provider. Your statutory rights are not restricted by this.

§ 10 Liability

We are liable without limitation for damages arising from injury to life, body or health, for damages based on intent or gross negligence, and under the German Product Liability Act.

In the event of a slightly negligent breach of material contractual obligations – that is, obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely – our liability is limited to the foreseeable damage typical for this type of contract. Liability is otherwise excluded.

§ 11 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you act as a consumer, mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.
